Terms of Use
vCloud.ai Video Surveillance as a Service (VSaaS)
1. Introduction
These Terms of Use (“Terms”) govern access to and use of the vCloud.ai Video Surveillance as a Service platform (“Service”) provided by vCloud.ai (“Company”, “we”, “our”, or “us”).
By accessing or using the Service, you (“User”, “Customer”, or “you”) agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
2. Description of Service
The Service provides cloud-based video surveillance software and infrastructure that allows users to:
- Connect IP cameras and video devices
- View live and recorded video streams
- Store video recordings
- Configure alerts, analytics, and access permissions
- Manage video surveillance infrastructure remotely
The Service may include:
- Web applications
- Mobile applications
- APIs
- Integrations with third-party systems
- Video analytics tools
vCloud.ai may modify or improve the Service at any time.
3. Account Registration
To use the Service, you must create an account.
You agree to:
- Provide accurate and complete information
- Maintain the confidentiality of login credentials
- Be responsible for all activities under your account
- Immediately notify us of unauthorized access
vCloud.ai is not responsible for losses caused by unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes.
You must NOT use the Service to:
- Violate any applicable laws or regulations
- Conduct illegal surveillance
- Record individuals in locations where surveillance is prohibited
- Upload malicious software or interfere with system operations
- Attempt to gain unauthorized access to the Service
- Reverse engineer, copy, or resell the Service without authorization
vCloud.ai may suspend or terminate accounts that violate these rules.
5. Customer Responsibilities
You are responsible for:
- Compliance with all local surveillance laws
- Obtaining required permissions to record video
- Informing individuals that video surveillance is in use where required
- Proper installation and configuration of cameras and devices
vCloud.ai does not monitor the legality of surveillance conducted by customers.
6. Video Data and Ownership
All video recordings, images, and data captured through the Service remain the property of the Customer.
However, by using the Service you grant vCloud.ai the limited rights necessary to:
- Store video data
- Process video streams
- Deliver analytics and alerts
- Provide technical support
vCloud.ai does not access customer video data except:
- When required to operate the Service
- For troubleshooting with customer permission
- When legally required
7. Data Retention
Video data retention depends on:
- Customer configuration
- Subscription plan
- Storage limits
Customers are responsible for managing storage and retention settings.
vCloud.ai may delete video data once storage limits are exceeded or retention periods expire.
8. Privacy
Use of the Service is also governed by our Privacy Policy, which describes how personal data is collected and processed.
Customers are responsible for ensuring that their use of video surveillance complies with applicable privacy laws, including regulations related to biometric or facial recognition data where applicable.
9. Service Availability
vCloud.ai will make reasonable efforts to maintain high availability of the Service.
However, the Service may experience interruptions due to:
- Maintenance
- Network failures
- Cloud infrastructure issues
- Force majeure events
vCloud.ai does not guarantee uninterrupted service unless specified in a separate Service Level Agreement (SLA).
10. Third-Party Services
The Service may integrate with third-party hardware, cloud services, or software.
vCloud.ai is not responsible for:
- Availability of third-party systems
- Performance of external devices
- Third-party security vulnerabilities
11. Fees and Payments
Certain features of the Service require paid subscriptions.
By purchasing a subscription you agree to:
- Pay all applicable fees
- Provide valid payment information
- Accept automatic renewal where applicable
Failure to pay may result in service suspension or termination.
12. Intellectual Property
All software, technology, and platform components of the Service remain the exclusive property of vCloud.ai.
You may not:
- Copy or distribute the platform
- Modify the software
- Create derivative works
- Reverse engineer the Service
Except as explicitly permitted in these Terms.
13. Limitation of Liability
To the maximum extent permitted by law, vCloud.ai shall not be liable for:
- Loss of video recordings
- Security incidents caused by misconfiguration
- Hardware failures
- Indirect, incidental, or consequential damages
The total liability of vCloud.ai shall not exceed the amount paid by the Customer for the Service during the previous 12 months.
14. Termination
vCloud.ai may suspend or terminate access to the Service if:
- The Terms are violated
- Payment obligations are not met
- The Service is used unlawfully
Customers may terminate their account at any time by contacting support.
Upon termination, stored video data may be deleted after a reasonable period.
15. Changes to Terms
vCloud.ai may update these Terms from time to time.
Updated Terms will be published on the website. Continued use of the Service after updates constitutes acceptance of the new Terms.
16. Governing Law
These Terms shall be governed by the laws of the jurisdiction in which vCloud.ai operates, unless otherwise specified in a customer agreement.
